Terms of Service

These Terms of Service (“Terms”) govern access to and use of Sastemny websites, workspace applications, APIs, and related services (collectively, the “Service”) provided by Sastemny. By creating an account, joining the waitlist, or using the Service, you agree to these Terms and our Privacy Policy and Cookie Policy.

If you do not agree, do not use the Service. For merchants selling to consumers in Egypt, you remain responsible for consumer-facing disclosures required under E-Commerce Law No. 162 of 2018 and Consumer Protection Law No. 181 of 2018.

1. Parties and eligibility

The Service is offered to businesses and authorised representatives aged 18 or older. You represent that you have authority to bind the business you register.

You may not use the Service if you are barred under applicable law or platform policies, or if you previously breached these Terms.

2. The Service

Sastemny provides a multi-tenant workspace for omnichannel conversations, catalog and orders, payments and wallet features, shipping integrations, Kayan AI assistance, and optional growth tools. Features vary by plan, market, and integration status.

We may add, change, or retire features. Beta or early-access features are provided “as is” with limited support.

3. Accounts and security

You must provide accurate registration information and keep credentials confidential. You are responsible for activity under your account and for configuring roles so staff access matches their duties.

Notify us promptly at security@sastemny.app if you suspect unauthorised access.

4. Merchant responsibilities

You are the seller of record to your customers. You must publish accurate prices, taxes, delivery terms, and refund rules on your storefront and channels as required by Egyptian e-commerce and consumer-protection rules when you sell in Egypt.

You must obtain valid consents and provide privacy notices to your customers for data you collect through the Service. You must not use the Service to send unlawful spam, infringe intellectual property, or process prohibited goods.

You grant us permission to host, transmit, and display content you submit solely to operate the Service.

5. Fees, billing, and taxes

Subscription fees are shown on our pricing page or in your order form in EGP for Egypt or other currencies for other markets. Fees are billed in advance per billing cycle unless stated otherwise.

Egypt payments may be processed through Paymob; supported markets use Paymob. You authorise us and our payment partners to charge applicable fees, taxes, and overages (e.g. message quotas, seats).

Fees are non-refundable except where required by mandatory law or expressly stated in writing. Failed payments may suspend access after notice.

6. Kayan AI and automation

Kayan generates suggestions and may take actions you enable (e.g. replies, order drafts, growth actions). You remain responsible for reviewing outputs before they reach customers or move money. Disable capabilities or require approvals where your risk tolerance requires.

We do not guarantee AI accuracy. Do not rely on Kayan for legal, medical, or financial advice.

7. Third-party platforms

Integrations with Meta, payment providers, and carriers are subject to their terms. Disconnecting a channel stops new sync but may not erase historical data until you delete it or request erasure under our Privacy Policy.

8. Intellectual property

We retain all rights in the Service, software, branding, and documentation. You receive a limited, non-exclusive, non-transferable licence to use the Service during an active subscription.

Feedback you provide may be used to improve products without obligation to you.

9. Confidentiality

Each party will protect the other’s non-public business information with reasonable care and use it only for the relationship. This does not apply to information that is public, independently developed, or lawfully received from a third party.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE MAXIMUM EXTENT PERMITTED BY EGYPTIAN LAW, WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.

11. Limitation of liability

TO THE EXTENT PERMITTED BY APPLICABLE LAW, SASTEMNY AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, EVEN IF ADVISED OF THE POSSIBILITY.

OUR AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE IN ANY TWELVE-MONTH PERIOD IS LIMITED TO THE FEES YOU PAID US FOR THE SERVICE IN THAT PERIOD, OR EGP 10,000, WHICHEVER IS GREATER, EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW (INCLUDING FRAUD OR WILLFUL MISCONDUCT).

12. Indemnity

You will defend and indemnify Sastemny against claims arising from your content, your sales to consumers, your breach of these Terms, or your violation of law or third-party rights, except to the extent caused by our gross negligence or willful breach.

13. Term, suspension, and termination

Either party may terminate for convenience with notice at end of the current billing period. We may suspend or terminate immediately for non-payment, security risk, or material breach.

Upon termination, access ends and you should export data beforehand. Sections that by nature should survive (fees owed, liability limits, indemnity, governing law) survive.

14. Governing law and disputes

These Terms are governed by the laws of the Arab Republic of Egypt, without regard to conflict-of-law rules.

The courts of Cairo, Egypt have exclusive jurisdiction, without prejudice to mandatory consumer protections that apply to you if you qualify as a consumer under Egyptian law.

Before litigation, parties will attempt good-faith negotiation for thirty (30) days after written notice of a dispute.

15. General

These Terms, the Privacy Policy, Cookie Policy, and any order form or data-processing addendum constitute the entire agreement. If a provision is unenforceable, the remainder stays in effect. Failure to enforce a right is not a waiver.
